These Terms of Use and Sale govern your use of designsbycv.com and purchases made from C&V Designs. Throughout these Terms, “C&V Designs,” “we,” “us,” and “our” refer to C&V Designs.
By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the website or purchase through it.
Website Use
You may use this website only for lawful, personal, and noncommercial purposes unless we give you written permission for another use.
You may not:
Interfere with the website’s operation or security
Attempt to gain unauthorized access to the website or related systems
Use automated tools to scrape, copy, or reproduce site content without permission
Misrepresent your identity or provide fraudulent information
Use our content, images, designs, or product information to create or sell competing or counterfeit products
Use the website in a way that violates applicable law or another person’s rights
Product Information
We make reasonable efforts to describe and photograph our products accurately. However, colors and surface details may appear differently depending on lighting, photography, and screen settings.
Many C&V Designs products are made in small batches, made to order, or produced from materials that naturally vary. Differences in wood grain, color, texture, finish, patina, and evidence of the making process are part of the character of these objects and are not necessarily defects.
Measurements and specifications are approximate unless expressly stated otherwise.
Availability and Orders
Products may be offered in limited quantities or produced after an order is placed. Adding an item to your cart does not reserve it.
We reserve the right to decline or cancel an order when reasonably necessary, including because of:
Incorrect pricing or product information
Product unavailability
Suspected fraud or unauthorized payment
Shipping restrictions
An error affecting our ability to fulfill the order
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.
Prices, Payment, and Taxes
Prices are shown in the currency displayed at checkout and may change without notice. The price charged will be the price shown when the order is submitted, except in cases of an obvious pricing or technical error.
Payment is due when the order is placed. Applicable taxes and shipping charges will be calculated or displayed during checkout.
Payment processing is provided by Squarespace and the payment provider available at checkout. Your use of a payment service may also be governed by that provider’s terms.
Shipping and Delivery
Available shipping methods, charges, and estimated delivery times are displayed during checkout or described in our Shipping & Returns Policy.
Production and delivery dates are estimates rather than guarantees unless we expressly agree otherwise in writing. Weather, carrier disruptions, customs processing, incorrect address information, and other circumstances outside our reasonable control may cause delays.
Customers are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address may be the customer’s responsibility to the extent permitted by law.
International customers are responsible for applicable import duties, taxes, customs charges, and local requirements unless stated otherwise at checkout.
Returns, Exchanges, and Damaged Orders
Returns, exchanges, cancellations, damaged shipments, and refunds are governed by our Shipping & Returns Policy, which forms part of these Terms.
Please inspect your order after delivery and contact us promptly if it arrives damaged, incomplete, or materially different from what you ordered.
Nothing in these Terms limits any consumer right that cannot legally be waived.
Product Use and Care
Use products only for their intended purpose and follow any care or use instructions provided with the product.
Unless expressly identified otherwise, our products are not certified safety equipment, medical devices, or instruments intended for safety-critical measurement or professional certification. C&V Designs is not responsible for damage or injury caused by misuse, improper installation, unauthorized modification, failure to follow instructions, or use for an unintended purpose.
Custom Work and Collaborations
Custom commissions, trade work, collaborations, and specially commissioned projects may be governed by a separate proposal or written agreement. If a separate agreement conflicts with these website Terms, the separate agreement controls for that project.
Intellectual Property
The website and its contents—including product designs, photographs, graphics, text, logos, videos, downloads, and other materials—are owned by C&V Designs or used with permission and are protected by intellectual-property laws.
Purchasing a product does not transfer ownership of its design or grant permission to reproduce, manufacture, distribute, or sell copies of it.
Digital files or open-project materials may be governed by a separate license displayed with the download. That separate license controls your use of those materials.
You may share links to our public pages for personal and editorial purposes, but you may not reproduce substantial portions of the website or use our content commercially without written permission.
Newsletter and Communications
If you subscribe to our mailing list, we may send occasional emails concerning new work, studio updates, products, and availability. You may unsubscribe at any time using the link included in each marketing email.
We may still send non-marketing communications necessary to complete a purchase, provide customer service, or address an account or product issue.
Third-Party Services and Links
The website may contain links to or integrations with third-party websites and services. We do not control those services and are not responsible for their content, availability, security, or privacy practices.
Disclaimer of Warranties
We aim to provide accurate information and carefully made products. However, to the maximum extent permitted by law, the website is provided on an “as available” basis without guarantees that it will always be uninterrupted, error-free, or free from harmful components.
Products are subject to any express warranty stated on the applicable product page or included with the product. We do not exclude or limit warranties or consumer rights that cannot legally be excluded.
Limitation of Liability
To the maximum extent permitted by law, C&V Designs will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products.
For claims relating to a purchased product, our total liability will not exceed the amount paid for the product giving rise to the claim, except where a different limitation is required by law.
These limitations do not apply where liability cannot legally be limited or excluded.
Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
Any dispute that cannot be resolved informally will be handled in a court with appropriate jurisdiction in Maryland, unless applicable consumer law requires otherwise.
Changes to These Terms
We may update these Terms when our website, products, business practices, or legal obligations change. Updated Terms will be posted on this page with a revised effective date.
Changes will not retroactively alter an order already accepted unless required by law or agreed to by the customer.
Severability
If any portion of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
